Description
This is a medical malpractice case. Nathan Trogun, plaintiff-appellant, was a patient of defendant-respondent, Dr. Robert Fruchtman, a specialist in internal medicine, from 1965 until September, 1968. In November, 1966, Dr. Fruchtman, based upon appellants prior medical records and certain tests revealing a premature arteriosclerotic condition, diagnosed Trogun as "possibly a diabetic" and placed him on a 1,500 calorie per day diet. Subsequently this diet was increased to 2,000 calories per day. In October, 1967, Dr. Fruchtman prescribed 100 milligrams of a diabetes medicine, Diabenese, for appellant and continued the diet.
